Effective as of January 31st 2021 The Baia Group Oy, Trade Registry Number FI 2887166-8 (hereinafter referred to as “BAIA”) protects the privacy of the users of our Service. This privacy policy (the “Privacy Policy”) describes how we collect, use, disclose, transfer and retain information, including your personal data, when accessing and using the BAIA Network platform and associated services, accessed through the VerifyScan Service application or infrastructure, including via associated websites like www.baia.net or www.verifyscan.com or www.baia.group, or similar web sites. Hence associated links and/or any other online communication method or offline software components, made available by BAIA for the purchase of products or management of Services (collectively hereinafter referred to as “Service”). BAIA is the controller of your personal data processed under this Privacy Policy pursuant to applicable Privacy law. By accessing and/or using Service, you acknowledge and accept the terms and conditions of this Privacy Policy and also give your express consent to the processing of your information and personal data as outlined below. This Privacy Policy incorporates by reference the BAIANET Terms of Service. The words and expressions defined in the Terms or Service have the same meaning for the purposes of this Privacy Policy unless otherwise is expressly specified.

  1. Collection of information and personal data

    1.1 Registration information When you create a BaiaNet Agent account, or otherwise directly utilize the Service, the personal information we collect may include your:

    • Name
    • Delivery Address
    • Email Address
    • Contact Number
    • Mobile Number
    • Date of Birth
    • Gender
    • Purchase History
    • Ordering Information
    • Location Information
    • Relevant Other Profile Data Provided

    You must only submit to us, our authorized agent or the Service, information which is accurate and complete and not misleading and you must keep it up to date and inform us of changes (more information below). We reserve the right to request for documentation to verify the information provided by you. If you register using a public social media account or link your BAIA account to your social media account or use certain other BAIA social media features, we may access information about you which you have voluntarily provided under your social media account via that social media provider in accordance with the provider’s policies and we will manage your personal data which we have collected in accordance with BAIA’s Privacy Policy.

    1.2 Use of the Service When you use the Service, we automatically collect certain information, including information on how you use the Service, such as (i) details of queries or messaging you make in the Service, and (ii) technical information, including e.g., the visited URLs, your IP-address, browser type and version, and operating system. We also use cookies on our Site to collect this information, please see section 5 below.

    1.3 Payment information Upon payment via the Service, we also collect such information necessary in order to process your payment, record your transactions for fraud prevention measures and or including credit card information or other payment channels when relevant. We may also retain any or all information regarding your transaction history.

    1.4 Surveys etc. If you participate in surveys or similar which we or third parties on our behalf conduct, we may collect additional information to what is stated in this Privacy Policy. This additional information may be combined with other information, e.g. information you have provided when you signed up for the Service or otherwise provided as a result of your use of the Service. We identify information to be collected in connection with conducting the survey.

    1.5 Information from public records We may supplement the information that you have provided with information gathered from various public records.

  2. How we use the collected information We may use the collected information, including your personal data, in order to give you access to the Service, in order to manage the Service, to ensure that the Service operates properly and to develop and improve the Service. We may also use the collected information for invoicing purposes and in order to administrate payments made via the Service. Furthermore, we may use the information in order to communicate with you regarding the Service, for direct marketing purposes and for other purposes set out in this Privacy Policy. Moreover, we may process your personal data if it is necessary in order to: (a) comply with applicable law and regulations and requests or orders from competent courts; (b) protect and defend our rights, our property or our interests; or (c) protect the users of our Service as well as (d) in the maturing of our Service capabilities.

  3. Security We are committed to protecting our users' information and personal data. BAIA takes appropriate technical and organizational security measures in accordance with the provisions of the applicable personal data law in order to protect your personal data against loss, theft, unauthorized access to or processing of your personal data as well as against accidental destruction, loss, alteration and disclosure of your personal data. Your personal password protects your user account when activated. You should therefore choose a unique and strong password, as well as log out from the Service when you are no longer using it. If you suspect that an unauthorized person has obtained your password or otherwise gained access to your user account you must immediately change your password. This is most easily done via Customer Support in the Service.

  4. Disclosure of information to third parties We may disclose the information we have collected, including personal data, to various third parties as follows.

    4.1 Producers and transportation service providers In order to provide the Service, BAIA cooperates with a number of Third-Party Vendors, Agents and transportation service providers. We may therefore disclose certain information, including your personal data, to such third parties in connection with administration of a purchase of Products.

    4.2 Third Party Service Providers We may disclose your personal data to various third-party service providers involved in the provision of Service e.g., to our payment service provider or marketing services provider or delivery service providers. These third-party service providers are given access only to the personal data necessary for the performance of their obligations in relation to us and they may only process your personal data in accordance with our instructions. They are also liable to take technical and organizational security measures to protect your personal data to the same extent as BAIA. BAIA may disclose your personal data to third parties in circumstances other than those listed above if it is necessary in order to: (a) comply with applicable laws and regulations or requests or orders from competent courts; (b) protect and defend our rights, our property or our interests, such as in a legal dispute; or (c) protect our users. Additionally, we may transfer collected personal data to third parties in the event of a reorganization, merger or transfer of business.

  5. Use of cookies and similar tracking technologies 5.1 What are cookies? We use cookies on our Site and Application. A cookie is a text file that is stored on your computer, smart phone or tablet for example to present custom web pages to visitors or to collect statistics.

    5.2 How we use cookies BAIA uses cookies for the following purposes. We use session and authentication cookies to make it possible to control and keep track of users logged into the Service. We use statistics cookies to measure how the Service functions and is used, and to collect visitor statistics in order to continuously improve and develop the Service. Functional cookies allow us to provide the Service you have requested, for example to remember your user name, any personal customization of the Service and in order to provide other features, such as correct language, currency, etc. when using the Service. By accessing and/or utilizing the Service, you expressly give your consent to our use of cookies for the purposes described above. Should you not wish that cookies are stored on your computer, smart phone or tablet, you may change your browser settings to disable cookies. Please note, however, that if you choose to disable cookies some parts of the Service may not work properly or at all.

  6. Location data When you use certain features of the Service, in particular the BAIANET platform, websites or other mobile application interfaces, BAIA may receive, store and process different types of information about your location, including general information (e.g., IP address, zip code) and more specific information (e.g., GPS-based functionality on mobile devices used to access the Service or specific features of it. We process and may give such location data to our third party subcontractors in order to provide the Service to you. You give your consent to use your location data as described afore in order to provide the Service for you. If you access the Service through a mobile device and you do not want your device to provide us with location-tracking information, you can disable the GPS or other location-tracking functions on your device, provided your device allows you to do this. See your device manufacturer’s instructions for further details.

  7. Retention of personal data BAIA retains your personal data for the time necessary to fulfill any of the purposes of our processing of your personal data as outlined in this Privacy Policy or to comply with law, regulations, requests and orders from competent courts.

  8. Transfer of data to third countries In order to provide the Service and to fulfill the other purposes specified in this Privacy Policy, we may transfer and process your personal data in other countries. By signing up for and using our Service, you expressly acknowledge and consent to this.

  9. Right of access and correction of data Each user is entitled to access his or her data that has been registered in his or her personal data file. You may at any time check and edit some of the information we store about you via the /profile command or relevant account settings section of the Service. You have the right to once a year, free of charge, request information of your personal data that is being processed by us. You have the right to request rectification of erroneous or incomplete data contained in your personal data file. The request for rectification must identify the error to be rectified, and provide correct information. You also have the right to request that personal data which has not been processed in accordance with the personal data act must be restricted, blocked or erased. The requests must be sent to the address identified below. You may at any time decline the use of your personal data for direct marketing purposes by notifying us via the e-mail address stated below. Moreover, you have the right to at any time revoke your consent for further processing of your personal data by unregistering your user account. Despite of closing your user account we have the right to keep your transaction history in our files and process it, when necessary.

  10. Changes and amendments to the privacy policy BAIA may amend or modify this Privacy Policy from time to time. At its own discretion or need. BAIA will in such a case notify such changes in the policy through the Service. You are deemed to have acknowledged and accepted such changes if you thereafter continue to use the Service.
